Draft court ruling seeks Sereno’s ouster

A draft decision calling for the ouster of Chief Justice Maria Lourdes Sereno has been districted to the Supreme Court justices after the Holy Week break, April 2, according to a report of the Manila Times Online on Thursday(Apr 12).

Court sources said the 60-page draft circulated by Associate Justice Noel Tijam declares the appointment of Sereno null and void as she was not eligible for the position due to question of integrity, for her failure to submit her statements of assets, liabilities and net worth as required by the Judicial and Bar Council (JBC) which screens judicial nominees.

The draft decision will order Sereno to quit immediately and mandate the JBC to open the nomination for the position of chief justice, said the sources.

The ruling, once approved by the majority of the, will be immediately executory pending motion for reconsideration.

The case will be up for voting after the submission of memorandum from the Office of the Solicitor-General which filed the quo warranto petition seeking to disqualify Sereno. Thereafter, the justices can submit separate opinions, either concurring or dissenting on the draft decision of Associate Justice Tijam.

The justices will attempt to decide on the case on April 24 because they will be in recess in May, said the sources, however, adding that June would be the best time to rule on quo warranto of Chief Justice Sereno.
