National Legislative Assembly president Pornpetch Wichitcholchai, today (March 27) dismissed media reports that the prime minister has returned the draft bill on the election of members of parliament back to the NLA.
Instead he said the draft is still in the hands of Prime Minister Prayut Chan-o-cha.
It was the prime minister’s authority whether he would pass on the draft to the Constitutional Court for interpretation, he said.
Mr Pornpetch also said that during the meeting of the National Council for Peace and Order today, he had clarified the prime minister the reason why the NLA didn’t submit organic law on election of MPs to the court for interpretation, but only the draft law on the senators selection.
Mr Pornphet said further that under the legal process, the prime minister and the NLA have the right to seek interpretation from the Constitutional Court.
Under the law, the Prime Minister has 25 days, or by April 12, to decide whether to seek the Constitutional Court’s vetting of the bill before presenting the bill to the King for endorsement.
However, the NLA also has the right to seek interpretation from the court by itself.
